If I attend one of your free consultations to seek advice about my debts, do you contact my creditors?



ANSWER:

A quick answer to that question is No. We do not directly contact your creditors. However, a Trustee is an officer of the Court and subject to the rules and regulations of the Bankruptcy and Insolvency Act. A Federal Act governs a Trustee in Bankruptcy. This Act along with professional standards, training, and federal governance and reporting standards gives assurance to both debtors and creditors that standard policies, procedures, ethics and fees are followed. When you visit a trustee office for a debt consultation, we will not disclose any information to creditors or other organizations unless or until you assign into bankruptcy or file a Consumer Proposal. However, if during the consultation, you disclose to the trustee or administrator that you have committed an illegal act, we must under federal law advise the Superintendent of Bankruptcy (federal office) of this fact.
